Terms of Service

These Terms of Service (“Terms”) are a contract between you and SportsVybe, LLC, a Florida limited liability company (“SportsVybe,” “we,” “us”). They govern your use of our website (sportsvybe.com), the SportsVybe mobile app, and the SportsVybe venue dashboard (together, the “Platform”).

You accept these Terms by checking the acceptance box when you create an account, by clicking “agree” when we present updated Terms, or by continuing to use the Platform. If you do not agree, do not use SportsVybe.

• You must be at least 18 years old. SportsVybe is for adults only. We do not offer accounts, bookings, or events for minors at this time.
• You must provide accurate account information and keep it updated.
• If you use the Platform on behalf of a business or organization (for example, as a venue operator), you represent that you are authorized to bind that organization, and “you” includes it.

SportsVybe is a marketplace that connects people who want to play recreational sports with venues that host them. Bookings work in one of two ways:

• Direct bookings. The venue is a SportsVybe partner set up for booking. When you book, your payment is processed at checkout and the venue is responsible for honoring the booking under its listed policies.
• Request-only bookings. Some venues require a booking request. You submit a request; we may forward it using the venue's listed contact information and coordinate confirmation. You are not charged unless and until the venue confirms your request. An authorization hold may appear as pending. If the venue declines or does not respond, the request expires and no charge is completed. The venue always decides whether to accept; we are not the venue's agent and have no authority to bind any venue.

SportsVybe does not own, operate, inspect, or control any venue. We provide the tools and infrastructure that make discovery, booking, and payment work. Some venues appear as directory listings for discovery only — see Section 4.

Some venues on SportsVybe are partner venues that have accepted our Venue Partner Terms. Others are listed so you can discover them and, where enabled, submit request-only bookings. Directory-style listings may use publicly available information.

• A directory or non-partner listing does not mean the venue is affiliated with, partnered with, or endorses SportsVybe.
• Venues can join as Partners, correct listing information, or ask us to remove a listing under our Unclaimed Listing & Claim Policy.
• Ratings come from SportsVybe users who completed a booking or attended an event there, using the Platform's rating tools.

• Use the Platform lawfully and respectfully.
• Follow our Community Guidelines, which are part of these Terms.
• Do not post offensive, harmful, or illegal content.
• Do not impersonate others or misrepresent your identity.
• Show up to bookings you make, or cancel them under the applicable cancellation policy.

Partner venues agree to provide accurate listings, honor confirmed bookings, maintain safe and operational facilities, and follow the cancellation framework described in our Cancellation & Refund Policy. The full set of venue obligations is in the Venue Partner Terms.

Payments are processed by Stripe. By paying through the Platform you also agree to Stripe's terms. Charges are processed through SportsVybe's Stripe platform account. Booking earnings are directed to the venue after the booking ends, and SportsVybe retains a convenience fee from the charge.

• Your total — including facility price, any venue-configured tax, and a convenience fee included in the total — is shown at checkout before you confirm. The convenience fee is added to every booking and covers a SportsVybe fee and card processing by Stripe; a breakdown is available at checkout.
• Venue prices and tax settings are set by venues; SportsVybe sets its convenience fee.
• For request-only bookings, your payment method is charged only after the venue confirms (Section 3). Until then your card is only held, and if the request is canceled, declined or expires the full hold, including the convenience fee, is released. Once your payment is successfully charged, the convenience fee is non-refundable.

Cancellations and refunds are governed by our Cancellation & Refund Policy, which describes cancellation windows, fee retention when you cancel, and how venue-initiated cancellations work. The applicable policy is shown before you book.

• SportsVybe administers refunds on the Platform in accordance with that policy and, when the venue cancels, the refund percentage the venue selects.
• For coordinated request-only bookings, SportsVybe may issue refunds through support when a confirmed reservation cannot be honored.
• If something went wrong with a booking, contact us through support.sportsvybe.com before disputing a charge with your bank — most issues are resolved faster that way.

• You can rate a venue or event only after a completed booking or attendance — ratings unlock after you attend through our post-event survey and reflect real visits.
• Ratings must reflect your honest experience. Fake, traded, or retaliatory ratings are removed and may lead to account termination.
• Ratings are public. We may display, aggregate, and moderate them under our Community Guidelines.

You keep ownership of the content you post (profiles, photos, ratings, event descriptions, messages). You grant SportsVybe a non-exclusive, worldwide, royalty-free license — including the right to sublicense to our service providers — to host, display, reproduce, and distribute that content for the purpose of operating, improving, and marketing the Platform. The license ends when you remove the content or delete your account, except that ratings and content you shared with other users (for example, a rating tied to a venue's history) remain licensed to us and may stay visible, since they reflect a real, completed visit and other users continue to rely on them.

SportsVybe's name, logo, design, and original content belong to SportsVybe, LLC and may not be copied or reused without permission.

If you believe content on the Platform infringes your copyright, send a notice under the Digital Millennium Copyright Act through support.sportsvybe.com with the information required by 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, the material you claim is infringing and where it appears on the Platform, your contact information, a statement of good-faith belief, and your signature under penalty of perjury. We respond to valid notices, including removing content and terminating repeat infringers where appropriate.

You may stop using SportsVybe and delete your account at any time. We may suspend or terminate your account if you violate these Terms, our Community Guidelines, or use the Platform in a harmful, abusive, fraudulent, or illegal way. Sections that by their nature should survive termination (including Sections 10, 14–18) survive.

Sports involve inherent risks — including serious injury. By booking, attending, or participating in any activity arranged through SportsVybe, you voluntarily accept those risks. We do not supervise, inspect, or control venues, the condition of facilities, the skill of participants, or the safety of activities. Consult a physician before beginning physical activity and use good judgment.

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are accurate, that venues will honor bookings, that the Platform will be uninterrupted or error-free, or that any activity will be safe. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

To the fullest extent permitted by law, SportsVybe, LLC and its owner, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury, property damage, or losses arising from venue conditions, participant conduct, or events and activities arranged through the Platform.

Our total liability for all claims relating to the Platform is limited to the greater of (a) the SportsVybe fees you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100). Some states do not allow certain liability limits, so parts of this section may not apply to you.

You agree to indemnify and hold harmless SportsVybe, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Platform in violation of these Terms, your violation of law, or your interactions with venues or other users.

Please read this section carefully — it affects your legal rights.

• You and SportsVybe agree to resolve disputes arising out of these Terms or the Platform through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
• Class action waiver: disputes will be resolved only on an individual basis — not as a plaintiff or class member in any class, consolidated, or representative proceeding.
• Small claims carve-out: either party may bring an individual claim in small claims court instead.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

We may update these Terms. When we make material changes, we will ask you to accept the updated Terms in the app or dashboard before continuing to use the Platform, and we will update the date at the top of this page. If you do not accept, you may stop using the Platform and your account access will end.
